Terms of Service

Welcome to Throwback. The operator of Throwback (“Throwback,” “we,” “us,” or “our”) provides social account authorization, media organization, and memory-film creation. By registering, accessing, or using the service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

1. Eligibility

You must be at least 13 and meet the digital-consent age in your location, or use the service with the consent and supervision of a parent or legal guardian. If you use Throwback for an organization, you confirm that you can bind it to these Terms.

2. Accounts and security

  • Provide accurate information and take responsibility for activity under your account.
  • Do not transfer your account, impersonate another person, or bypass authentication or security controls.
  • Protect your credentials and contact us promptly if you discover unauthorized access.
  • Connect only Instagram or Facebook accounts that you own or are legally authorized to use.

3. Social-platform authorization

When you connect Instagram or Facebook, you authorize Throwback to access the account and media within the permissions shown by Meta. You can revoke access in Throwback or Meta’s Apps and Websites settings. Revocation stops future retrieval; previously synced data is handled under the Privacy Policy and your deletion choices.

Instagram, Facebook, and Meta are third-party services outside our control. Their terms and policies also apply. API, permission, or account-status changes may make features unavailable. Throwback is not sponsored, endorsed, or acting as an agent of Meta Platforms, Inc.

4. Your content and license

You retain your lawful rights in content you upload, sync, or select. You grant us a non-exclusive, worldwide, royalty-free, limited license, sublicensable to necessary providers, to process that content only as needed to sync, analyze, render, store, play, download, maintain, and protect the service. This does not transfer ownership and ends when the content is deleted, except for legally required retention or isolated backups.

You confirm that you hold the necessary rights or permissions for people, music, trademarks, and other third-party material in your content. A generated film does not create new rights in third-party content.

5. Acceptable use

  • Do not violate law or infringe privacy, copyright, trademark, or other rights.
  • Do not upload malicious code, attack or scan the service, interfere with it, or access accounts without authorization.
  • Do not scrape, bulk-copy, reverse engineer, or bypass access controls, rate limits, or content protections.
  • Do not distribute fraudulent, hateful, harassing, exploitative, or otherwise illegal or harmful content.
  • Do not impersonate others, create deceptive content, or process another person’s social data without permission.

6. Generated results

Automated organization and generation can produce mistakes, incomplete information, or unexpected edits. Review every result for accuracy, legality, and suitability before publishing, sharing, or relying on it. Results are not guaranteed to be unique.

7. Changes and availability

We reasonably maintain the service but do not guarantee uninterrupted or error-free availability. Maintenance, networks, third-party platforms, cloud services, or generation jobs may cause outages. We may improve, change, or discontinue features and will give reasonable notice when a change materially harms your rights where practicable.

8. Fees

A feature without a displayed price is not a promise that it will remain free. Before charging for future paid features, we will display the price, billing period, refund terms, and other applicable conditions and obtain your confirmation.

9. Suspension and termination

You may stop using the service, disconnect third-party accounts, and request deletion at any time. We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created a security risk, infringed rights, or if law requires us to act.

10. Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available,” without express or implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, or suitability of generated results. This does not exclude rights that cannot legally be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Throwback is not liable for indirect, incidental, special, punitive, or consequential losses, or for loss of data, profit, goodwill, or business opportunity. Limits do not apply to intentional misconduct, gross negligence, or liability that law does not allow us to limit.

12. Changes to these Terms

We may update these Terms as the service, law, or security practices change. We will communicate material changes by product notice, account message, or another reasonable method and update the date above. Continued use after the effective date means acceptance unless law requires separate consent.

13. Governing law and disputes

These Terms are governed by the law applicable where the Throwback operator is located, without reducing mandatory consumer rights in your place of residence. Please contact us first to try to resolve a dispute; unresolved claims may be brought before a court with lawful jurisdiction.
